Terms & Policy

This agreement is entered into between "Devout", a Sole Propriatorship owned and operated by Jon-Mark van Rooyen and the quoted party.

The information on this website is provided for information only. While the information on this website has been compiled in good faith, no representation is made as to its completeness or accuracy. Devout makes no commitment, and disclaims any duty, to update or correct or to provide notice as to any error or omission in any report or other information on this website.

Devout reserves the right to add, modify and delete information on this site at any time. If you have questions regarding this policy, you should first contact us.

CopyrightsAll services provided by Devout may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any Federal, State, Provincial or City law is prohibited. This includes, but is not limited to; copyright material, or material we deem threatening. It is the responsibility of the Client to provide Devout with content, text, images, and any other media that is deemed acceptable. Any and all original content created by Devout remains property of Devout unless specified, and we reserve the right to have reference to Devout placed on any and all web pages posted for the Client. Said content may be transferred to the Client only with expressed written consent from Devout.


Limitation of LiabilityDevout will not be liable for indirect, special or consequential damages, or any loss of revenue or profits, arising in connection with the projects that we develop/developed.

Devout is not responsible for any server side problems incurred due to server down time, hosting issues, ISP down time, or Acts of God.

Devout reserves the right to delay or stop any project development for any reason without liability. Devout will notify the client immediately of any changes of project development status, and make appropriate arrangements.

If a project in development is canceled by Devout the client will be refunded the deposit minus any billable hours. Devout is not responsible for any damages incurred from hacking, hackers, illegal activity, nor any changes made to websites created and maintained by Devout without prior permission.

If the client is not on a maintenance option, Devout is not obligated to restore website backups, upgraded Joomla versions and Joomla Extensions, or correct damages. However, we can and will repair any damages incurred to the Clients Website/s using the current pricing policy guidelines.

With regards to Joomla and Joomla extensions.

Joomla! is an open source Content Management System (CMS). Joomla, the CMS, can be used free of charge. Our Joomla service to our clients is customizing and creating websites on the Joomla framework. We did not create Joomla, or any of its extensions, and therefore we don't guarantee Joomla or any Joomla extension.   


Project ContentsAll digital and non-digital materials supplied by the client to Devout for project development must be, either owned by the client or given copyright permission for publication. Devout is not responsible for copyright infringements found on these materials.


Cancellation of Project DevelopmentA request to cancel project must be made in writing to Devout and include the signature of the authoritative client. Devout will charge for the number of hours accumulated in project development before the cancellation request is made.


Pause in Project DevelopmentA request to pause project development must be made in writing to Devout and include the signature of the authoritative client. The delay will not exceed a period of 30 days. Unless other arrangements are made between both parties, Devout will assume any delay requested by the client that exceeds the 30-day period a cancellation, and hence will charge for the number of hours accumulated in project development before the request to pause is made.


Payment PolicyA 50% deposit is due upon the agreement of the contract under the agreement of the Terms of Service. The full balance will be due before the clients website can go live.

If for some reason, the website needs to go live before the final deposit has been paid, Devout reserves the right to charge a %5 late fee for every 7 days the balance is past due. Devout reserves the right to suspend any and all current work being done due to failure of Client to remit payment.

Please note that there is no guarantee that any email sent to Devout will be received by Devout, or that the contents of the email will remain confidential during internet transmission.


PortfolioDevout reserves the right to display client projects on their portfolio.
